Occurred 9/24/11, 7:37 p.m.  Burglary of a Building     5301 S. Staples     1109240147

Officers responded to Banuelos Tire Shop for a burglary in progress when a 55-year-old homeless woman  reported she observed a Hispanic male attempting to steal a tool box from a boat. 

The woman called police who arrived to find Jose Cortez (12/11/91) inside ransacking the business.  Cortez used bolt cutters to cut the burglary bars and gain access to the Office. 

A bag containing burglary tools and a couple of  company checks was located inside the business.  The burglary bag was tagged as evidence and the checks were returned to the 74-year-old owner.

Cortez was arrested and charged with Burglary of a Building along with an outstanding Nueces County warrant for Failure to Appear, Driving Under the  Influence of Liquor.
