An Officer, working radar enforcement on 11/27/2011, clocked a vehicle traveling at a high rate of speed. The Officer attempted to pull the vehicle over, but the driver refused to stop. The driver of the white 2001 Nissan Maxima continued driving erratically as he headed southbound on Kostoryz Road striking and driving up on the curb several times. The Officer, fearing the driver was intoxicated, requested the deployment of “spikes” to stop the vehicle.
The pursuit continued through several residential streets in which the driver failed to stop for a posted stop signs. The driver lost control of the vehicle and struck a metal US Postal mail box and a concrete corner of a property gate.
The driver reversed toward the Officer, stopped and fled westbound on Saratoga Boulevard towards Greenwood Drive, failing to stop for the red light at SH 286. The pursuit continued on Greenwood Drive, where the driver turned onto Gavilan Street and drove through the neighborhood until he fled westbound on Holly Road.
The suspect lost control of his vehicle on the curve at 5655 Bush and struck a dirt culvert and chain link fence. The driver, Joshua Norberto Luna (07/17/90) bailed from the vehicle and fled on foot, leaving the three passengers behind. The passengers included a three-month-old baby, his 18-year-old mother, and two 19 year-old males. All passengers were checked by CCFD Emergency Personnel and not injured in the accident.
The suspect was located hiding in a dump truck and arrested. Luna was charged with Abandoning/Endangering a Child, Evading Arrest with a Vehicle, Evading Arrest on Foot, Reckless Driving and two counts of Duty on Striking Fixture/Hwy Landscape. He was also charged with two counts of Unsafe Change from a Direct Course and two counts for Failing to Remain and Report an Accident.
