Officer E. Roman observed a yellow Chevrolet pick-up truck traveling on the wrong side of the road with both front doors open.  The Officer pulled the truck over and talked to both the driver and passenger.  While doing so, he caught a whiff of Marijuana coming from the vehicle.

Both the driver Andrew Andres-Daniel Vargas (08/13/92) and the passenger Michael Garibay (01/11/92) were arrested when a baggie of Marijuana was found and Garibay lied about his identity.

Both Vargas and Garibay were charged with Possession of Marijuana.  Garibay was additionally charged with several outstanding Nueces County warrants for Probation Violation on a Possession of Marijuana charge (No Bond) and Failure to Appear for Evading, Failure to Identify, and Indecent Exposure ($5,000 Bond).  Garibay also had an outstanding Municipal Court warrant for Violation of Promise to Appear with a $477.10 Bond.
