Occurred Thursday, July 05, 2012, 2:13am, 6425 S. Padre Island Dr. Public Intoxication, 1207050023, 1207050024

A 41-year-old man got a face full of pepper spray and then arrested after the man struggled with a security guard when the man refused to give up his beer after the nightclub closed for business for the night.

The staff for Club Cheetah attempted to collect the alcoholic drink from 41-year-old Byron Scruggs (7/21/1970) after 2:00am in compliance with state law, but Scruggs refused. A 46-year-old security guard collected the drink and Scruggs assaulted the security guard.

The security guard sprayed Scruggs with pepper spray to stop the attack, and then placed Scruggs in handcuffs to wait for police to arrive. The club staff provided Scruggs with water to relieve the effects of the pepper spray. An ambulance provided treatment at the scene to the security guard for minor scratches as a result of the assault.

Scruggs was arrested for public intoxication and a report was generated for further investigation for the assault on the security guard.
