Two Area Women Head to Federal Prison in Home Health Services Conspiracy

CORPUS CHRISTI, Texas –Debra Jean Velasquez, of Robstown, and Sylvia Salinas Ramirez, of Driscoll, have been ordered to prison in a scheme to defraud the Texas Medicaid program through fraudulent home health billings, announced United States Attorney Kenneth Magidson along with Texas Attorney General Greg Abbott. The woman entered guilty pleas Sept. 4, 2013, to conspiring to submit false and fraudulent bills to the Texas Medicaid Program by wire transmissions as well as wire fraud. 

Today, Senior U.S. District Judge Janis Graham Jack handed Velasquez, 42, and Ramirez, 52, respective terms of 51 and 41 months in federal prison for wire fraud and conspiracy to commit wire fraud. In handing down the sentence, Judge Jack noted that the sentence was necessary considering the number of victims, the need to deter future criminal conduct and to protect the public. Both will also be required to serve a term of two years of supervised release following completion of the prison term. 

The two women admitted that from or about Aug. 1, 2009, through on or about June 15, 2010, they were employed by the Corpus Christi office of MRNG Inc. doing business as Caring Touch Home Health. During that time, they conspired to submit false and fraudulent bills through wire transmissions to the Texas Medicaid program and the Medicaid funded managed care organizations known as Evercare of Texas LLC and Superior Health Plan Inc. for home health services that had not been provided. Ramirez and Velasquez admitted they created false and fraudulent time sheets for former Caring Touch employees for home health services that had not been provided and then fraudulently billed Medicaid, Evercare and Superior in the name of Caring Touch for those non-existent services. They sent approximately 562 of those false and fraudulent bills by wire. 

Ramirez and Velasquez also admitted that in order to personally profit from their fraudulent billings, they created phony payroll records from the fraudulent time sheet which they then sent to Caring Touch’s payroll staff. Ramirez and Velasquez then obtained the payroll checks generated from the false and fraudulent time records, forged the signatures of the former Caring Touch employees, then cashed the checks and divided the money among themselves. Caring Touch and the former employees whose names were used on the false time sheets and checks were not accused of any wrongdoing.  

Ramirez and Velasquez admitted that as a result of their false and fraudulent claims, Texas Medicaid, Evercare and Superior paid the approximate aggregate sum of $155,127.72. As part of their pleas, the women have agreed to pay restitution in that amount.  

Previously released on bond, Ramirez and Velasquez were taken into custody following the sentencing today where they will remain pending transfer to a U.S. Bureau of Prisons facility to be determined in the near future. 

The charges were the result of a joint investigation conducted by officers and agents of the Corpus Christi Police Department, the FBI, Department of Health and Human Services – Office of Inspector General and the Texas Attorney General’s Medicaid Fraud Control Unit. Special Assistant United States Attorney Rex Beasley and Assistant United States Attorney Jeffery D. Preston are prosecuting the case.

Corpus Christi Man Sentenced for Possession of Child Pornography

CORPUS CHRISTI, Texas – Rex D. McBride, 44, has been ordered to prison for possession of child pornography, announced United States Attorney Kenneth Magidson. McBride pleaded guilty Sept. 18, 2013.

Today, Senior U.S. District Judge John D. Rainey considered the seriousness of the crime and sentenced McBride to a total of 63 months in federal prison to be followed by 10 years of supervised release.

On Nov. 12, 2012, Corpus Christi Police Department – Internet Crimes Against Children (CCPD-ICAC) detectives were conducting an undercover investigation into persons trading child pornography on the Gnutella network. At that time, detectives identified an online user, later identified as McBride, who was offering child pornography for distribution. On three occasions in late 2012, detectives successfully downloaded child pornography from McBride.

On March 20, 2013, a search warrant was executed, during which McBride admitted to downloading and viewing child pornography on the Internet through file sharing software. A forensic evaluation of McBride’s computer led to the discovery of nearly 1500 images of child pornography.

Homeland Security Investigations and CCPD-ICAC investigated.

This case, prosecuted by Assistant United States Attorney Lance Duke, was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Corpus Christi Police arrested 35-year-old Jose Delarosa (12/15/1978) for burglary of two vehicles, three charges of criminal mischief, evading arrest, and possession of marijuana at an apartment complex located at 5750 Curtis Clark Drive Wednesday morning. Corpus Christi Police responded to a complaint of a man who broke into a vehicle at about midnight. Officers arrived and saw Delarosa in a vehicle and confronted him. Delarosa ran from the Officers, but Officers chased and apprehended Delarosa. Delarosa was found with contraband and additionally charged with possession of marijuana. Officers met with several witnesses who accused Delarosa of destroying a fence, a tailgate to a truck, and a window with an estimated total loss of $400. Delarosa was delivered to the city detention center.

Corpus Christi Police arrested 28-year-old Liza Vasquez (6/5/1985) for Driving While Intoxicated on the 4400 block of Haverhill Lane Wednesday morning. Corpus Christi Police responded to a vehicle crash in which a gray 2000 Ford Expedition struck a house. Officers learned the Expedition traveled south on the 5600 block of Flynn Parkway and left the roadway into a ditch. The Officers believe the Expedition then went back onto the road, spun and traveled backward to strike a street sign, then a fire hydrant and then a tree. The Officers believe the Expedition then traveled forward and struck a house. The Officers believe the Expedition reversed to strike the same tree again, and then moved forward to strike a parked and unattended gray 2013 Honda Accord. The Officers arrested the operator of the Expedition, 28-year-old Liza Vasquez, and took her to the hospital for a medical evaluation and to collect a specimen of her blood. Officers impounded the Expedition and delivered Vasquez to the city detention center.

Corpus Christi Police Crash Investigators are investigating a hit and run crash that happened on the Crosstown Expressway near Gollihar Monday night. Corpus Christi Police responded to a vehicle crash with a pedestrian on the 4800 block of the Crosstown Expressway at 11:52pm Monday night. Officers learned that a 52-year-old man put fuel in a stalled vehicle on the shoulder when the 52-year-old man was struck by a passing truck. The 52-year-old man was taken to the hospital with life-threatening injuries. The Officers learned that the truck continued to travel south on the Crosstown Expressway and did not return to provide aid or information as required by state law.

Corpus Christi Police Investigators from the Traffic Safety Section seek a dark-colored Dodge 1500 truck between the year models 1994-2001 which has the passenger side mirror broken off as involved in this crash. The 38-year-old woman told Officers she said she had no money in the register because the store just opened and the man then demanded her personal cash. The 38-year-old woman told Officers the man left with nothing after she told him she had no money. The 38-year-old woman told Officers she believes there was a second man who waited outside the store as a lookout and both men were about 20 years in age and wore hoodies.

Corpus Christi Police arrested 29-year-old Christopher Edwards (12/22/1983) for Aggravated Assault Tuesday at a nightclub at 6410 Weber Road. Corpus Christi Police responded to a fight which involved several people at 1:47am. Three people went to the hospital for treatment of non life-threatening injuries. Officers learned that Edwards displayed a knife in the fight and attempted to cut the bouncers of the club as they escorted him out of the club. Corpus Christi Police arrested Edwards for Aggravated Assault. Officers additionally charged Edwards with possession of a controlled substance when the Officers discovered he had contraband concealed in his shoes. Edwards was then delivered to the city detention center.

Corpus Christi Police arrested 24-year-old Robert Mendiola (6/21/1989) for burglary of a vehicle at 6410 Weber Road Tuesday morning. Corpus Christi Police responded to a fight complaint at a nightclub at 6410 Weber Road at 1:47am and conducted an arrest. While the responding Officers investigated the assault, Officers learned that one of the customers at the club saw Mendiola in the customers white Chevy Tahoe stealing. Officers arrested Mendiola for Burglary of a Vehicle. Officers additionally charged Mendiola with possession of a controlled substance when they discovered Mendiola had medication not prescribed to him, and then delivered Mendiola to the city detention center.

Case Number: 1312160140

Corpus Christi Police responded to a vehicle crash with a bus on the 3800 block of MacArthur Monday night. Corpus Christi Police learned that a tan 2003 Mercury Sable operated by an 18-year-old man drove south on MacArthur in a 30 mile per hour speed zone, lost control of the vehicle, swerved into oncoming traffic, and struck a Regional Transit Authority bus and a black Saturn sedan. There were five passengers on the bus who were all not injured and the Saturn was unoccupied. The 18-year-old was taken to the hospital with non life-threatening injuries. Corpus Christi Police discovered evidence that the 18-year-old man consumed alcoholic beverages and the Investigating Officers initiated an investigation for Driving While Intoxicated. Corpus Christi Police collected a specimen of blood from the 18-year-old man while at the hospital. The 18-year-old man remained in the hospital for treatment.

CVS Burglary Suspect’s Identity Sought

Corpus Christi Property Crimes Detectives are asking the public’s assistance to help identify the suspect  caught on surveillance video burglarizing the CVS Pharmacy at 4101 Hwy 77.  The suspect can be seen breaking the glass entry door to access the store.  The suspect then breaks into the pharmacy area and takes over $3,600 in pills.  The damage is estimated at $3,000.

The suspect was wearing a gray sweat suit with a black hoodie and a black hat.  A white cloth can be seen covering the suspect’s face.

Corpus Christi Auto Theft Detectives are asking the public’s assistance to help identify the suspect  caught on surveillance video burglarizing the victim’s vehicle at a local restaurant.  The suspect vehicle a charcoal gray four-door sedan pulls into the parking lot and parks next to the victim’s blue Yukon.  Shortly thereafter, the suspect vehicle can be seen as it drives away towards Flynn Parkway.

The 55-year-old woman described the suspect to Police as a man who was about 5 feet 8 inches tall, 180 pounds, and wore a gray hoodie and a blue bandana over his face. No arrests have been made.

Corpus Christi Police responded to a vehicle crash that involved three vehicles at Curtis Clark and Staples at 11:34pm Friday night. Corpus Christi Police Crash Investigators believe a white 1997 Jeep Grand Cherokee operated by 24-year-old Hector Garcia (9/26/1989) crashed through a fence and then struck a gray 2012 Nissan Altima operated by a 23-year-old woman and then struck a red 2008 Ford Fusion operated by a 28-year-old woman. None of the vehicles had passengers other than the operators. All three were taken to the hospital for treatment of their non life-threatening injuries and the vehicles were towed due to damage. Garcia was treated and released from the hospital and arrested for driving while intoxicated. Corpus Christi Police collected a specimen of his blood and then delivered him to the city detention center.

Corpus Christi Police provided traffic control for a brush fire on Padre Island Saturday afternoon. Police discovered a 24-year-old man drove his vehicle in an area not open to the public and where vehicles were prohibited and the vehicle became stuck. Officers and Fire Fighters believe heat from the vehicle caused the grass to ignite and burn an unpopulated area of Padre Island. No injuries were reported. Corpus Christi Police received a criminal complaint against the 24-year-old man for Criminal Trespass and Reckless Destruction. No arrests have been made and Police continue to investigate.

A 27-year-old woman reported a burglary to her home located at the 600 block of Cunningham Street Saturday to the Corpus Christi Police. The 27-year-old woman told Officers she arrived home and discovered some unknown person broke the front door to her home without permission while the home was left unattended between 7:15pm and 10:40pm Saturday night. Corpus Christi Police Officers made sure no person was inside and then the 27-year-old woman told Officers her game console was missing. No injuries were reported and no arrests have been made.

A 58-year-old man reported a burglary at his home at the 700 block of Harmon Street Monday morning to the Corpus Christi Police. Corpus Christi Police responded to a fight at the 700 block of South Port Avenue at 4:25am and found an injured 26-year-old man. Witnesses told Officers that the 26-year-old man leaped over a fence, fell, and struck his head on a brick that laid on the ground. The witnesses directed Officers to a 58-year-old man on the 700 block of Harmon and the 58-year-old man told Officers the 26-year-old man had just committed a burglary at his home. The 58-year-old man told Officers he heard a noise in his living room and went to investigate. The 58-year-old man told Officers he discovered his television missing, so he went outside to look around. The 58-year-old man told Officers he saw 26-year-old Lupe Sanchez (1/2/1987) with his television and he confronted Sanchez. The 58-year-old man told Officers Sanchez dropped the television and then fought with the 58-year-old man, and then stole the wallet from the 58-year-old man. Witnesses told Officers Sanchez then jumped the fence and injured himself. The wallet and television were returned to the 58-year-old man. Sanchez was taken to the hospital for treatment of his injuries and then arrested for burglary of a habitation and for robbery. Sanchez was then delivered to the city detention center.

Offenses: Driving While intoxicated (P.C. 49.04), Evading Arrest (P.C. 38.04) and Criminal Mischief (P.C. 28.03)

On December 13, 2013 off duty officers from another jurisdiction were following a vehicle that appeared to have an intoxicated driver. The suspect vehicle stopped in the area of 2000 Treyway. CCPD officers attempted to make contact with the driver. The suspect driver got back into his vehicle and fled the scene. Officers attempted to catch up to the driver who was driving erratically. The suspect drove through a park, striking a fence and began dragging about 100′ of chain link fence behind his vehicle . A CCPD supervisor called off the pursuit. The suspect vehicle continued until it was involved in a three car accident at Curtis Clark and South Staples. The suspect was ejected from his vehicle. The suspect and a accident victim were transported to area hospitals. Their condition is unknown at this time. If the suspect, who is a 24 year old male, is released from the hospital he will be booked into CDC. The incident is still being investigated by Follow Up Investigators at this time.
